Wi-Fi Terms of Use

BY CONNECTING TO ANY WIRELESS INTERNET NETWORK MADE AVAILABLE TO YOU BY PETSMART, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE WI-FI TERMS OF USE BETWEEN YOU AND PETSMART, UNDERSTAND THEM, AGREE TO BE LEGALLY BOUND BY THEM, AND HAVE THE LEGAL CAPACITY TO DO SO.
IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE OR ACCESS THE NETWORK.
Your Responsibilities
You may access and use the Network only from within PetSmart’s stores. You may not do anything to render the Network inoperable or to make its use more difficult. You may not submit inaccurate information via the Network, commit fraud or falsify information in connection with your use of the Network, or act maliciously against the interests or reputation of PetSmart. You may only use the Network for lawful purposes. You are responsible for complying with all local, state, and federal laws and regulations that apply to your use of the Network.
Monitoring and Privacy
YOU DO NOT HAVE ANY EXPECTATION OF PRIVACY OR SECURITY WHEN USING THE NETWORK.
PetSmart has the right to monitor your communications and activities via the Network and collect, use, and disclose any information it gathers in a manner consistent with our Privacy Policy. When you access the Network, we automatically collect information about your device, including:
- Information related to your access to and use of the Network, including the websites you visit while using the Network, date and time of connection, and idle time.
- Information about the device you use to access our Network, including the hardware model, operating system and version, unique device identifiers, and mobile network information.
- The precise location of your device and movement within our stores.
We use the information we collect to:
- Provide, maintain and improve our products and services;
- Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, and protect the rights and property of PetSmart and others;
- Undertake internal research for technological development and demonstration;
- Undertake activities to verify or maintain the quality or safety of a service or device that we own, manufacture, or control, and to improve, upgrade, or enhance the service or device that is owned, manufactured, manufactured for, or controlled by, us; and
- Create de-identified, anonymized, or aggregated information that we process only in a de-identified fashion and will not attempt to re-identify except as permitted by law.
We may disclose the information we collect to:
- To vendors, service providers, and consultants that perform services for us;
- In response to a request for information if we believe disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements;
- To detect fraud, or if we believe your actions are inconsistent with our user agreements or policies, if we believe you have violated the law, or to protect the rights, property, and safety of PetSmart or others;
- In connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business by another company;
- Between and among PetSmart and our current and future parents, affiliates, subsidiaries, and other companies under common control and ownership; and
- With your consent or at your direction.
Prohibited Use
You agree not to use the Network to transmit or receive any material or other communications that: (i) are, as determined at PetSmart’s sole discretion, unlawful, malicious, fraudulent, harassing, obscene, indecent, tortious or harmful to PetSmart, its guests or any other party; (ii) violate another’s intellectual property, privacy or other rights (including by intercepting, collecting or harvesting any material or other communications transmitted or received by other users of the Network); or (iii) otherwise interfere with the operation, use or enjoyment of the Network or any other service, system or property. In addition, you may not use the Network to transmit or receive any virus, worm, Trojan horse, Easter egg, time bomb, spyware or other computer code, file or program that is harmful or invasive or may damage or hijack the operation of any hardware, software, or equipment.
PetSmart has the right to, at any time and at its sole discretion, block material, websites, or other resources, and suspend or terminate an individual’s access to the Network for any or no reason at all.

THE NETWORK IS PROVIDED “AS IS,” “AS AVAILABLE,” AND WITHOUT ANY WARRANTY OF ANY KIND AS A CONVENIENCE TO YOU. PETSMART DISCLAIMS ALL WARRANTIES AND REPRESENTATIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY WARRANTIES: (i) OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT; OR (ii) THAT ACCESS TO OR USE OF THE NETWORK WILL BE SECURE, UNINTERRUPTED, FREE OF VIRUSES OR OTHER HARMFUL CODE, OR THAT PROBLEMS WILL BE CORRECTED, EVEN IF PETSMART KNOWS OF THE PROBLEMS. NO ADVICE OR INFORMATION GIVEN BY PETSMART OR ITS ASSOCIATES CREATES ANY WARRANTY. YOUR ACCESS TO AND USE OF THIRD-PARTY WEBSITES THROUGH USE OF THE NETWORK IS AT YOUR OWN RISK AND IS SUBJECT TO THE PRACTICES OF THOSE THIRD-PARTY WEBSITES.
YOUR USE OF THE NETWORK IS AT YOUR OWN RISK AND YOU ARE RESPONSIBLE FOR ANY DAMAGE TO YOUR HARDWARE, SOFTWARE OR SYSTEMS, AND ANY LOSS OF DATA OR ANY OTHER DAMAGE THAT RESULTS FROM USING THE NETWORK.
No Liability
PETSMART AND ITS AFFILIATES, SHAREHOLDERS, DIRECTORS, OFFICERS, ASSOCIATES, AND AGENTS HAVE NO LIABILITY FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL, PUNITIVE OR EXEMPLARY DAMAGES (INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOSS OF BUSINESS, BUSINESS INTERRUPTION, LOSS OF DATA OR CONFIDENTIALITY OR SECURITY, OR OTHER SIMILAR DAMAGES) ARISING OUT OF OR RELATED TO THESE TERMS OR THE NETWORK, EVEN IF PETSMART HAS EXPRESS KNOWLEDGE OF THE POSSIBILITY OF ANY DAMAGES. YOUR SOLE AND EXCLUSIVE REMEDY IS TO STOP ACCESSING AND USING THE NETWORK.
Miscellaneous
These Terms are the entire agreement between you and PetSmart regarding your access to and use of the Network. PetSmart’s failure to enforce any provision in these Terms will not constitute a waiver of that provision or any other provision.
Last Update
PetSmart reserves the right to update or revise these Terms at any time without prior notice. Your continued use of the Network signifies that you have read, understand, and agreed to the latest Terms. These Terms were last updated on May 22, 2024.
